Terms of Sale and Delivery

These Terms of Sale and Delivery govern the ordering, sale and delivery of goods displayed on the Alkotakso Tallinn (alkotaksotallinn.ee) website.

1. Seller

The seller of the goods is:
Alkotaksotallinn.ee
Hereinafter referred to as the Seller.
The website alkotaksotallinn.ee provides information about the product range and how to contact the Seller.

2. Age Restriction

Alcoholic beverages are sold and handed over exclusively to persons aged 18 or over.
The Seller verifies the buyer’s age both when accepting the order and when handing over alcoholic beverages.
To verify age, the Seller may require a valid identity document or use another age verification method permitted by law.
If the buyer’s age cannot be reliably established, the Seller may refuse to accept the order.
Upon delivery, the courier may ask the recipient to present an identity document. If the recipient cannot be confirmed to be aged 18 or over, the alcoholic beverage will not be handed over.
Alcohol will also not be handed over to anyone showing clear signs of intoxication or where there are clear grounds to believe that it is being purchased for a minor or a person showing clear signs of intoxication.

3. Placing an Order

To obtain information about product availability, current prices and delivery terms, the buyer contacts the Seller via Telegram or another communication channel specified by the Seller.
Simply sending a message or enquiry, or clicking the “Contact us” button on the website, does not constitute placing an order and does not create any obligation to make a purchase.
Before the contract is concluded, the Seller informs the buyer of:

  • the selected goods and their quantity;

  • the final price of the goods, including applicable taxes;

  • delivery charges and any other potential additional costs;

  • the payment method;

  • the estimated delivery time and location;

  • any other essential terms of the order.

Before confirming the order, the buyer is given an opportunity to review these Terms of Sale and Delivery.
The buyer confirms that they have read and accepted the terms.
The Seller then checks whether the order can be fulfilled and sends the buyer explicit confirmation that the order has been accepted.
The sales contract is concluded only once the Seller has sent confirmation accepting the order.
Until that point, correspondence between the parties is regarded as an exchange of pre-contractual information.

4. Alcohol Sales Hours

Enquiries may be submitted through the website or Telegram at any time.
However, alcoholic beverages are sold and the corresponding contracts are concluded only during the hours permitted by law.
As of the effective date of these terms, retail sales of alcoholic beverages take place:
from 10:00 to 22:00.
If an enquiry is received outside the permitted hours, it may be processed during the next permitted sales period.
If an order is received shortly before 22:00 and cannot lawfully be fulfilled and handed over to the buyer before the restriction takes effect, the Seller may offer delivery during the next permitted period.

5. Product Prices

The current price of a product is communicated to the buyer individually before the order is confirmed.
All final prices quoted to the buyer include applicable taxes, unless expressly stated otherwise in accordance with the law.
The buyer is informed of the final total cost of the order, including delivery charges and any other mandatory payments, before confirming the order.
Once the contract has been concluded, the price of the confirmed order cannot be changed unilaterally.

6. Payment

Payment for the order is made by:
Bank transfer / bank card / payment on delivery.
The payment method available for a particular order is communicated to the buyer before the order is confirmed.
The Seller provides the buyer with proof of purchase in accordance with the requirements of Estonian law.

7. Delivery

Delivery is available within:
Tallinn.
The exact delivery charge and estimated delivery time are communicated to the buyer before the order is confirmed and depend, among other things, on the delivery address and the terms of the particular order.
Alcoholic beverages may be handed over to the buyer or an adult recipient designated by the buyer only during the hours permitted by law.
Alcoholic beverages are not handed over during delivery between 22:00 and 10:00.
Placing an order before 22:00 does not entitle the buyer to demand that alcohol be handed over after 22:00.
The buyer must provide a correct and complete delivery address and contact details, and ensure that the order can be handed over lawfully.

8. Receiving an Order

When receiving an order, the recipient must, at the courier’s request, present a valid document establishing their age.
If the order is received by another person designated by the buyer, that person must also be aged 18 or over and comply with the age verification requirements.
The Seller or courier may refuse to hand over alcoholic beverages if:

  • the recipient is a minor;

  • the recipient cannot be reliably confirmed to be aged 18 or over;

  • the recipient shows clear signs of intoxication;

  • there are clear grounds to believe that the alcohol is intended for a minor or a person showing clear signs of intoxication;

  • handing over the goods would breach statutory restrictions on delivery hours or any other legal restrictions.

Such a refusal does not constitute improper performance by the Seller if it is necessary to comply with legal requirements.
Any charges for delivery already carried out or an unsuccessful delivery attempt will be determined with regard to the costs actually incurred, the terms communicated to the buyer in advance and applicable law.

9. Contract Confirmation

After accepting the order, the Seller sends the buyer confirmation of the contract by email or on another durable medium that allows the buyer to retain the information in an unchanged form.

10. Right to Withdraw from a Distance Contract

If a contract is concluded with a consumer through a means of distance communication, the consumer has the statutory right to withdraw from the contract within 14 days without giving a reason, unless a specific statutory exception applies.
When purchasing goods, the 14-day period generally begins on the day the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods.
The fact that a product is an alcoholic beverage does not, in itself, automatically exclude the right to withdraw from a distance contract.
A specific statutory exception may apply, in particular, to alcoholic beverages whose price was agreed when the contract was concluded, but whose delivery is scheduled to take place more than 30 days later and whose actual value depends on market fluctuations beyond the Seller’s control.
To exercise the right of withdrawal, the consumer may send the Seller an unequivocal statement of their decision to withdraw from the contract using a method permitted by law.

11. Returning Goods Following Withdrawal

After giving notice of withdrawal, the buyer must return the goods to the Seller within the statutory time limit.
If the buyer was informed in advance that they would have to bear the direct costs of returning the goods, those costs are borne by the buyer unless otherwise provided by law.
The Seller refunds the payments received from the buyer within the statutory time limit. In cases provided for by law, the Seller may withhold the refund until the returned goods or proof that they have been sent back has been received.
The buyer may handle the goods only to the extent necessary to establish their nature, characteristics and functioning, as they would when examining goods in a physical shop.
If the value of the goods has diminished as a result of handling beyond what is necessary, the buyer may be liable for that diminished value to the extent provided for by law.

12. Defective Goods and Complaints

The Seller is responsible for ensuring that the goods conform to the contract to the extent required by law.
The consumer may submit a complaint to the Seller concerning a lack of conformity of the goods with the contract within two years of receiving the goods, in accordance with Estonian law.
If a problem is discovered, the buyer is advised to contact the Seller as soon as possible and provide:

  • their name and contact details;

  • the order number or other order details;

  • the purchase date;

  • a description of the defect;

  • their preferred resolution;

  • where necessary, photographs or other materials that help assess the problem.

The Seller responds to a consumer’s written complaint within 15 days, unless otherwise provided by law.
These terms do not restrict the consumer’s statutory rights in relation to defective goods.

13. Order Cancellation and Inability to Perform

Before the contract is concluded, the Seller may inform the buyer that the selected goods are unavailable, that delivery to the specified address is not possible, or that the order cannot be fulfilled on the proposed terms.
If, after the contract has been concluded, it becomes apparent that performance is objectively impossible, the Seller informs the buyer without undue delay and refunds any payments received for the unfulfilled order in accordance with the law.
The Seller may not replace the ordered goods with other goods without the buyer’s consent.

14. Personal Data

The buyer’s personal data is processed to the extent necessary to process the order, perform the contract, deliver the goods, comply with legal requirements and resolve any complaints.
More detailed information about the processing of personal data is available in the Privacy Policy on the Alkotakso Tallinn website.
A copy of an identity document is not retained without a separate lawful basis.

15. Dispute Resolution

The parties seek to resolve any disagreements through negotiation.
The consumer may submit a written complaint to the Seller using the contact details set out in Section 1 of these terms.
If the parties cannot resolve the dispute themselves, the consumer may refer it to the Consumer Disputes Committee (Tarbijavaidluste komisjon) of the Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet), provided that the statutory conditions for the committee to consider the dispute are met.
The consumer also retains the right to bring proceedings before a competent court.

16. Applicable Law

The relationship between the Seller and the buyer is governed by the laws of the Republic of Estonia.
These terms may not be interpreted in a way that restricts the consumer’s mandatory rights under Estonian law or applicable European Union law.

17. Amendments to the Terms

The Seller may amend these Terms of Sale and Delivery in response to changes in legislation, service procedures or for other justified reasons.
Each order is subject to the version of the terms in force when the corresponding contract was concluded.
